Acceptance of Terms
These terms and conditions ("Terms") govern all supply of goods and services ("products") by Mali Contractors Ltd T/A Floorboards ("Floorboards", "we, "us") to you, the purchaser of products from us via our website at floorboards.co.nz ("the website") or by phone or email. They are effective from 01.04.25 and will replace all earlier Floorboards terms of trade and any conditions contained in any document used by you and purporting to have contractual effect.

We reserve the right to change these Terms by notice to you. Notice may be given by posting the revised terms and conditions on our website.

If you are purchasing on behalf of another entity, such as a company, you confirm you are authorised to agree to these Terms on behalf of the entity.

Products

Website Images
The images on our website are for illustrative purposes only. We aim to show each sample image or room setting as true to life as possible, but actual colours and grain shades may vary due to your device's display settings, and also ambient and artificial lighting will affect how the flooring colour is perceived in different room settings. If you require a specific floor colour please contact us to view larger samples in person.

Content
While we endeavour to ensure the information throughout our website is accurate and up-to-date, omissions and errors may occur. We reserve the right to change information regarding prices, products, specifications and ranges at any time and without notice. We do not accept responsibility or liability for any loss or damage resulting from the content or absence thereof on this site. Please do not copy or replicate any information without prior consent from Floorboards. All images and website content is protected by copyright.

Natural Products
Natural products will have variations in colour, knots, grain, texture, stain or any other feature in accordance with processes associated with natural goods. We expect to see some maturation of natural products with time, such as naturally-occurring colour changes with exposure to light and heat, as well as the dents, dings and scratches to the real natural product layer/s that show a home lived in. This maturation cannot be regarded as a product fault.

Product Performance
We make it clear during our in-store conversations that although some flooring surfaces will perform better than others (e.g. laminate versus timber), no flooring surface is immune to damage. Damage including but not limited to scratches, dents, dings, sun fade, stains, water-related damage or other damage related to incidents, accidents, or insufficient or incorrect care may not be covered by your product's warranty. However we 100% back our products and their warranties and are committed to meeting our obligations to the Consumer Guarantees Act, especially in the rare event of a genuine product failure. Please check with us regarding your specific product's warranty or warranties, as many of our products have wear, stain and fade warranties as well as lifetime structural warranties for your peace of mind and ours.

Installation on Quoted Projects
We understand that building and renovation processes necessitate some flexibility with dates and timing, so we will do our best to facilitate your requested installation date and changes of installation dates with our schedule. Please give us as much notice as possible regarding date changes.

Availability and Supply

Stock
We endeavour to carry all flooring types that we feature online and in our showroom, but in some instances, our products may be out of stock, limited in supply, or available on indent (order-in) only. If this is the case, we will notify you and if necessary, suggest the nearest alternative product.

Clearance Stock
Stock is strictly limited. Please ensure the quantity available is sufficient flooring for your project. We will not be able to order extra product as these are end-of-line clearance items. Please measure your space carefully for product quantity required. We recommend allowing a minimum of 10% of extra flooring product for waste. Trims, underlay, installation kits are sold separately and not included with clearance flooring purchases.

Pricing
All prices on our website are in New Zealand Dollars and are inclusive of any Goods and Services Tax. All product prices are exclusive of delivery fees and packaging. All prices are correct when published. We reserve the right to alter prices at any time.

Website Purchases: Delivery

Delivery
Delivery is not available for items purchased on our website, unless by prior arrangement.

Pick Up
Once you have purchased your order on our website, please contact our team on 07 959 1861 to arrange collection from our Hamilton or Tauranga locations during normal business hours. All product is stored off-site, please allow us at least 2 working days to prepare your order. Failure to collect your prepared order may result in a re-stocking fee.

Direct Credit
We accept payment by Direct Credit to our bank account below. All direct credited funds must be cleared in our bank account before we can prepare and send your order.

Security

Credit Card Security
We do not retain your credit card number on our website. All payments are processed via Stripe's secure payments system to ensure high levels of payment security and are subject to Stripes's terms and conditions.

Refunds, Returns and Exchanges
Please choose carefully as we do not refund or exchange if you change your mind. If the products are faulty, we will meet our obligations under the Consumer Guarantees Act.

Liability Limitation
Where you acquire or hold yourself out as acquiring goods or services from us for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 will not apply. The conditions, warranties and guarantees set out in the Contracts and Commercial Law Act 2017 or otherwise implied by statute or common law will not apply and are excluded from these terms of trade.

To the greatest extent permissible by law, we exclude all liability we may have to you for any claim except where we have acted in bad faith. This exclusion also applies for the benefit of every officer, employee, contractor, agent of us and anyone else we use to perform our duties or provide services under any agreement you have with us. None of the persons specified above is liable or has to pay you for anything else in connection with or resulting from anything any of us does or does not do, or delays in doing, whether or not it is contemplated or authorised by any agreement you have with us. This exclusion applies whatever you are claiming for and in whatever way liability might arise. This exclusion does not limit any inalienable rights you may have under the Consumer Guarantees Act 1993.

Our maximum liability to you (if any) will be limited to the value of any faulty products supplied by us and we, our employees, contractors and agents, will not be liable to you for loss or damage of any kind however that loss or damage is caused or arises.

Applicable law and jurisdiction
Unless we otherwise agree in writing, these Terms, and our Website Terms of Use contain all the terms of our relationship and continues to apply no matter where you are located at the time any goods or services are provided to you by us and irrespective of the location where you reside.

Use of our website, supply of products by us to you and any other matter arising from these Terms are subject to the laws of New Zealand. The Courts of New Zealand will have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these Term, or with the use of website or supply of any products.

General Conditions
If we fail to enforce any terms or to exercise our rights under these Terms at any time, we have not waived those rights.

If any provision of these Terms is held to be invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and the parties shall adjust their respective rights and obligations in accordance with the spirit and intent of the parties as shown by these Terms.

Unless any provision in this agreement expressly provides otherwise, these Terms are not intended to confer a benefit on any person or class of person who is not a party to them. We may deliver notices to you by sending them to an email address that you have notified to us.
